North Dakota Gambling Laws
North Dakota seems to be not the best gambling-friendly state with wide restrictions beyond the Tribes or charitable sector. The Gaming Division handles all gaming regulations in the state.
Tribal Casinos
Although commercial casinos are illegal, tribal ones are allowed. There are 5 Native American casinos that have an agreement with the state. These tribe outlets provide classic casino game including poker, blackjack, slots, craps and bingo. Some of the tribal casinos in the state are the Spirit Lake Casino and Resort in St. Michael, the Prairie Knights Casino and Resort in Fort Yates, and the 4 Bears Casino and Lodge in New Town. Players must be at least 21 years old to enter and play.
Pari-Mutuel Betting
Betting on horse races and greyhound races are legal in Peace Garden State but these legal forms of gambling can only be played on authorized racing tracks, for example, at North Dakota Horse Park. However, there are no greyhound tracks in this state, so only simulcast games are available for this kind of betting. Operators of tracks must obtain required permits and licenses from the state first before holding a simulcast race track event. For pari-mutuel betting, the participant must at least be 21 years old. Spectators who are at least 18 years of age are allowed for the simulcast racing events as long as they do not participate in the betting.
Lottery
North Dakota Lottery is the only sanctioned lottery game in the state. Under this authorized lottery event, there are five multistate games. Lottery bettings cover only the drawing games, rest of the scratch-off cards games and terminal betting are not fall under its regulation.
Charitable Gaming
Bingo games are regulated using the Charitable Gaming Laws of North Dakota. As the name of the law implies, only non-profit organizations and tax-exempt charitable institutions can organize bingo games in the state. These organizations must obtain legal permits and licenses before operating. The gaming law for this form of gambling is more directed to operators than participants. Any non-profit organization or charitable institution operating the raffle event must keep in mind that real estate prizes are prohibited. Only cash and merchandise rewards are allowed. A single cash reward must not go over $1,000 and the total prize money for one raffle event must not exceed $300,000. There is no age limit when playing authorized bingo games or raffle events in the state, but minors should be supervised or accompanied by an adult.
Online Casino
North Dakota does not regulate online gambling that involves real-money betting. A proposal for the North Dakota Internet Poker Bill had been submitted in 2005 but was denied a few years later.
Charitable Gaming Laws of North Dakota also allow games of poker, calcutta, paddlewheels, punchboard or pull tabs, sports pool, and twenty-one, but with strict limitations. For example, these games may be conducted only during the hours when alcoholic drinks may be dispensed.
Anyone who is caught participating in illegal gambling in North Dakota will be charged depending on the game played. If the hand or game is under $25, there won’t be any charges filed. Bets between $25 and $500 will be deemed as an infraction, and any wager over $500 will result to a Class A misdemeanor. On the other hand, the operators of illegal casino gambling will face a more severe penalty. Any person who is caught with gambling device will be charged as well. When found guilty, the illegal operator will be charged with a Class C felony.
